Absolutely brilliant, Greg. I'm so glad I read it this morning. Appreciate you.

Excellent article. Thank you for pointing out specifics about what is protected by 1st Am. jurisprudence, both from what protesters can express and how government responds.

So refreshing to read this non-partisan blog.

How to get yourself shot: with a handgun in your waist band go up to police in an aggressive and unhinged manner and then resist arrest. A policeman standing over you has no distance or reaction time for safety if you pull out a weapon. One twitch or sharp movement and you will be shot.

Tell us when that happened, Rob. Because it sure wasn’t in Minneapolis.

There’s a reason police tell suspects to slowly put their hands up.

Many protests have an implied or direct threat of violence. I support stronger time, place and manner restrictions.

Renee Good and Alex Pretti were murdered in cold blood.

Thousands of peaceful protesters and people just going about their lives or staying in their homes have been assaulted, attacked, detained, kidnapped, and shipped off by the criminal actions of ICE thugs.

But sure, support "stronger time, place, and manner restrictions." It's a good look.

If the case unlikely even goes to trial, they will be found innocent.

Protest may be free expression but it usually does not rise to the level of speech, as in communicating an idea or logic. We see more protest than speech because comments by Mayor Frey, such as ICE is unconstitutional, are indefensible.

In Minneapolis with the whistle blowing and camera in the face, shouting insults at law enforcement paid and duty bound to follow the law, the main purpose of the protected activity is to give cover for the interruption of law enforcement, all part of organized low level insurgency.

I guess we chalk that up on the costs of free speech side of the ledger.

That's a damned narrow definition of freedom of speech you have there.

pgwerner, Rob R Baron defends fascists, and does so proudly. He, like all of MAGA, tells us who he is with every breath.

That is a form of civil disobedience that subjects the protestors to lawful arrest. Not on-the-spot execution. The utter failure of the political right in this current moment is their failure to recognize that just because someone has broken the law or in some way failed to "comply" with law enforcement, that does not mean they have 100% forfeited their basic rights.
